Just received a reply from ADOT (Arizona Dept. of Trans.). Here is their take on Elio at this time:

ADOT Response: Good morning. Arizona relies on the National Highway Traffic Safety Administration (NHTSA) to determine the classification of vehicles (motor vehicles, motorcycles, motor driven cycles, etc.). Since NHTSA has not yet made a determination on Elio Motors or any 3-wheel vehicle similar to an Elio vehicle, it would be premature for MVD to advise customers on whether or not the Elio vehicle can operate in Arizona’s HOV lanes (as a motorcycle) or even how Arizona would classify these vehicles. Moreover, the Elio vehicle is not in production and, additionally, the Arizona Department of Transportation would have to conduct an inspection of this vehicle before making a final determination. This is a link to MA general laws Definitions.Due to its enclosed body the Elio is excepted from being a motocycle.
Here is the condensed information.. Good work locating that info Steve! Looks like Mass. will not consider the Elio a motorcycle..

" "Motorcycle'', any motor vehicle having a seat or saddle for the use of the rider and designed to travel on not more than three wheels in contact with the ground, including any bicycle with a motor or driving wheel attached, except a tractor or a motor vehicle designed for the carrying of golf clubs and not more than four persons, an industrial three-wheel truck, a motor vehicle on which the operator and passenger ride within an enclosed cab, or a motorized bicycle."

Nice to see you again raybonz. Thank you for extrapolating that. If I had realized you were going to do it I would have skipped reading all that other stuff. LOL Of course this does not change the fact that the Elio is a motorcycle according to Federal regulations and will therefore have a mc vin. Does this mean your Elios will be licensed as cars and therefore pay insurance and other car fees? It will be interesting to see how this all eventually falls into place. :-) Z
