I wouldn't, play the game with them for a bit longer, then get your lawyer to go with you, go down to where it is getting fixed (sat on) and tell them, your tired of being jerked around, I see you haven't done shit to my vehicle, I want a full refund, and we're done.
Make sure they know they person with you is your lawyer, get your cash (cash only, no checks) and wave bye, bye at them.
You don't want a check, because it can get tied up, and hassled for who knows how long.
If they don't have the cash, sit and wait, or tell the owner to give you his car till they have cash. (This is where a lawyer is nice to have with you).

I'm with Coss on this one, well maybe not the full method. Not all of us can't afford an attorney as a back up.
You tried going through the horses butt for a solution, how about getting back to the horses mouth, the MFG.
That is only if you really really want the vehicle.

I would look into lemon laws for your state. In some states, it's not just how many times to fix it but the length of time too. With lemon law, it's the manufacturer or importer is the one that buys it back.

I would not keep it at all. If this is the problem you are having now, then it's going to happen again. With this model discontinued, you can forget abut ever getting parts for it no matter if they claim they are the same as another model. That's just a way to make you feel better today not when there is an issue a year from now and you say, "They told me all of the parts are the same as (insert model here)."

I watched this played out about 10 years ago when I seen this scooter sitting in the corner of a customers shop. I asked him about it and he said, "You want it? I'll give it to you for free." Come to find out, he bought it from a place a year before I seen it. Come to find out, that make and model of scooter was no longer made and the manufacturer quit the US market. So, when things started to break, which happened not long after he bought it, the parts and service took a month at a time. So since he has a machine shop, he just made some of the replacements himself. Then when the transmission took a dump, he called it a day. Even one of his employees is really into motocross and repairs all sorts of dirt bikes, won't touch it. I found out not long after that, he put in front and a sign that said, "FREE". It was gone in a day.

Any vehicle can certainly be a ‘lemon,’ irrespective if any laws would be applicable or enforceable. Besides even trying to invoke the ‘Lemon law’ even in jurisdictions that allow it is a time consuming PITA. Just go for broke and get the public eye and embarrass them. No one, especially in today’s climate, likes negative exposure.

When I went down there the other day (for the 1st time), I discovered it is a real shithole of a place. Basically a few big bays with golf carts/cars packed in like sardines, overflowing all the way to the street and onto the sidewalk. Where there are no carts is the "office", just desks next to the wall with no A/C for employees and misc. crap all over the place. They couldn't even find paperwork for my Tag/Title to give me refund for the massive overpayment. I spoke with the tech in their shop (located elsewhere), and he basically says most days he feels like quitting.
