And now, they say its not going to be assembled in Shreveport, La. This whole venture is a scam, and I want my $1,000 back.

2. Nature of Agreement; Non-Binding Reservation Payment
The Reservation Payment is NON-REFUNDABLE and provides you with the benefits in Section 4 below depending on the level of your payment. This Agreement does not constitute an agreement for the sale of a vehicle and does not lock in pricing, a production slot, or an estimated delivery date. You are under no obligation to purchase a vehicle from us, and we are under no obligation to supply you with a vehicle.

Don't read this either, just sue, I'm sure you have a leg to stand on..
oh and by the way, this isn't hidden on the 100th page of the agreement, this is only about 70 words in, it's not small print, its right there, I made it red so all you need to do is read whats in red here to understand what you (we) signed up for.

Let's give him a break. He put up his money and is frustrated, much like the rest of us.
Let him vent. We all know there is no legal recourse and he will too, but just needs to get this off his chest.

It's one thing to be frustrated with the delays, it's another to declare the "whole venture is a scam", I guess that's what made me fire back so hard, and unless you're 10 years old you should have read the whole agreement and understood what it said. If one reads the second part of the agreement then jumps up and down about (really) anything, you didn't get it. It's like people loosing at a casino and then suing for their money back. ( unless you were really drunk ) You are just being a bit spoiled. I don't hit myself with a hammer then claim to be a victim and sue Craftsman.
I guess I've read too many crybaby posts on Facebook that have made me a bit jaded.

  1. who is "they"?
  2. where did you read that information?
  3. did you read the agreement before you paid your money?
  4. what gave you the idea that this is an official Elio Motors web site?

You are, by your number a 1K all in, and (I think), you are also not a "customer". Before you spend money on a lawyer, read what you signed.
There seems to possibly be a "market" for your "investment" if you were to get permission from EM. However, the spot-in-line doesn't transfer with the exchange, which will help the rest of us as we then move up the line {:-).
Good luck with your situation. I hope you get it resolved to your satisfaction.

It's important for Reservationists and Crowdfunders to read and fully understand what they sign before sending money. The Elio reservation contract was simple and understandable, but most of us trusted the production and delivery date on a rather simple to build production vehicle. Particularly during the period of the "we have the funding to start production" and don't need the ATVM Loan statements were made. There wouldn't have been nearly as many reservations had the anticipated delivery date been set at 2016-17 from the get-go. After-all nobody wants to tie up a grand for four years particularly if they needed a new vehicle within a years time and the grand was their down payment. I understand his frustration and disappointment.
